FOOTISHFUN – BUYER & SELLER AGREEMENT

1. Definitions

• Buyer: A user who purchases or accesses digital content or subscriptions from Sellers.
• Seller (Creator): A user who uploads digital content and offers it for sale or subscription.
• Content: Digital media including photos, videos, written descriptions, and other uploads.
• Platform: The FootishFun website located at www.footishfun.com.
• Transaction: A purchase, subscription, or digital sale completed between a Buyer and Seller through FootishFun.

2. FootishFun's Role

FootishFun operates as a digital marketplace and intermediary.

FootishFun is not:

• The creator or producer of Seller content
• A party to the contract between Buyer and Seller
• Responsible for the actions of Buyers or Sellers
• Liable for the quality, legality, accuracy, or nature of Seller content

FootishFun provides:

• Hosting
• Payment processing (via CCBill)
• Verification systems (via AgeGo)
• Customer service
• Content moderation
• Compliance and safety tools

Buyers and Sellers transact directly with each other through the Platform.

3. Age Verification

Mandatory for All Users:

• All Buyers and Sellers must complete AgeGo verification confirming they are 18+.
• Sellers must complete full KYC (identity verification, facial match, and documentation).
• Buyers must pass age verification before accessing adult content.
• Accounts failing verification may be restricted or terminated.

4. Seller Responsibilities & Required Consents

Sellers agree to and represent that they:

• Upload only content they own or have full legal rights to distribute.
• Have obtained explicit, informed, written consent from all individuals depicted in their content, confirming:
  • Consent to being recorded and/or photographed;
  • Consent for the content to be uploaded to and publicly distributed on the FootishFun platform; and
  • Consent for the content to be accessed, viewed, and downloaded by other users, where platform functionality permits.
• Have verified and confirmed that all individuals depicted are 18 years of age or older at the time the content was created.
• Maintain written consent records and age/identity documentation for all individuals depicted and agree to provide such records upon request by FootishFun, CCBill, or relevant authorities.
• Provide accurate pricing, descriptions, and classifications for all content.
• Comply with all FootishFun policies, including:

• Terms of Service
• Content Guidelines
• Copyright Policy
• DMCA Policy
• Age Verification Policy
• Prohibited Content List

• Not upload or promote prohibited content, including underage, non-consensual, violent, or illegal material.
• Cooperate fully with investigations, disputes, audits, and takedown requests.
• Not redirect Buyers off-platform for payment or content access.
• Maintain an active Seller subscription (£4.99 or £14.99 per month) to continue selling content.

Sellers are solely responsible for ensuring their content is lawful, consensual, and compliant.

5. Buyer Responsibilities

Buyers agree to:

• Use purchased content for personal, non-commercial use only.
• Not copy, screenshot, record, distribute, resell, or share content outside the Platform.
• Not harass, threaten, blackmail, or coerce Sellers.
• Not request illegal or prohibited content.
• Not solicit in-person services, meetups, or real-world sexual activity.
• Not attempt chargeback fraud.
• Not bypass paywalls or content protections.

Violations may result in permanent account termination and legal action.

6. Transactions & Payments

All payments are processed securely through CCBill. FootishFun does not store card information.

Buyers:

• May purchase individual content items
• May subscribe to Sellers monthly
• Subscriptions renew automatically until cancelled
• Digital purchases are final (see Refund Policy)

Sellers:

• Receive 85% of earnings
• FootishFun retains 15% commission
• Earnings may be adjusted for refunds or chargebacks
• Must pass AgeGo and CCBill verification to receive payouts

FootishFun may temporarily hold funds during compliance reviews or disputes.

7. Content Licensing

Sellers retain full copyright ownership of their uploads.

By uploading content, Sellers grant:

• Buyers a limited, non-transferable licence to view purchased content; and
• FootishFun a limited licence to host, display, distribute, and deliver content for platform operation.

Buyers have no right to download, reproduce, resell, distribute, record, or screenshot content.

8. Refunds

All refunds are handled exclusively by CCBill on a case-by-case basis.

Billing Issues:

If you'd like to cancel your subscription and not be billed again, or for any billing questions including refunds, please contact CCBill via phone 1.888.596.9279 or email consumersupport@ccbill.com.

Refunds issued to Buyers may be deducted from Seller earnings.

9. Disputes Between Buyers & Sellers

FootishFun is not responsible for disputes, including pricing disagreements, content expectations, or subscription misunderstandings.

We may intervene if safety, legality, fraud, or policy violations are involved.

FootishFun's decisions are final.

10. Prohibited Conduct

Strictly prohibited:

• Underage content (real or simulated)
• Non-consensual content
• Harassment, abuse, extortion
• Fraud or chargeback abuse
• Copyright infringement
• Deepfake impersonations without consent
• Off-platform payment circumvention

Violations may lead to permanent account removal and reporting to authorities.

11. Removal of Content

Content may be removed if it violates laws, policies, or receives a valid complaint or DMCA notice.

Content already purchased may remain accessible to Buyers in accordance with digital goods regulations.

12. Appeals Process

If you have been depicted in content and wish to appeal its removal, contact info@footishfun.com.

If disagreement remains, the appeal may be reviewed by a neutral third party.

13. Liability

Buyers and Sellers acknowledge that FootishFun is not liable for user behaviour, user-generated content, disputes, or misuse of content.

14. Termination

Accounts may be suspended or terminated for violations, fraud, failed verification, prohibited content, piracy, or harassment.

Termination may result in loss of access to content or earnings.
