FOOTISHFUN – DMCA & CONTENT REMOVAL POLICY

1. DMCA Compliance (Copyright Claims)

Although FootishFun is a UK-based platform, we voluntarily comply with the U.S. Digital Millennium Copyright Act (DMCA) to ensure global copyright protection.

If you believe content on our Platform infringes your copyright, you may submit a DMCA Takedown Notice.

Your notice must include:

• Your full legal name
• Your contact information (email and/or address)
• Identification of the copyrighted work
• Identification of the infringing material (URL or profile link)
• A statement that you believe in good faith that the material is not authorised
• A statement that the information you provide is accurate
• A statement under penalty of perjury that you are the copyright owner or authorised to act on their behalf

How we respond to DMCA notices

• We acknowledge receipt within 48 hours.
• We remove or disable access to the content promptly (usually within 72 hours).
• We notify the Creator who uploaded the content.
• The Creator may submit a DMCA Counter-Notice if they believe the removal was made in error.
• If a valid counter-notice is received, we may restore the content unless legal action is initiated.
• Repeated infringement will result in account suspension or permanent removal.

2. Content Removal Requests (Consent, Privacy & Safety)

FootishFun allows individuals to request removal of content involving:

• Their image or likeness
• Content uploaded without consent
• Impersonation or stolen identity
• Doxxing, harassment, or privacy violations
• Deepfake or AI-generated impersonations

To request removal, email:

• Link(s) to the content in question
• Your relationship to the content
• Explanation of the issue
• Proof of identity (required to prevent fraudulent claims)

Removal process

We aim to review and respond within 72 hours, and urgent safety cases are prioritised.

If content violates our Terms, we will:

• Remove the content
• Warn, suspend, or permanently ban the Creator
• Report serious violations to law enforcement

3. Underage Content (Zero Tolerance Policy)

FootishFun has zero tolerance for any content involving actual or simulated minors, including AI-generated minors.

If any content is suspected of involving a minor:

• The content is removed immediately
• The account is suspended
• AgeGo verification logs are reviewed
• The case may be reported to child protection authorities

Reports of underage content are treated as urgent and investigated immediately.

4. Prohibited Content Removal

Content may be removed for violating our Terms, including:

• Non-consensual content
• CSAM (Child Sexual Abuse Material)
• Bestiality
• Incest
• Violence or extreme material
• Rape or non-consensual themes
• Trafficking or exploitation
• Stolen or copied content
• Impersonation
• Fraudulent or misleading behaviour
• Copyright infringement
• Breaches of AgeGo verification requirements

Creators are responsible for ensuring they have full rights to upload the content.

5. Reporting Infringing or Harmful Content

Users can report content directly through the Platform or by contacting us:

Reports will be reviewed within 5 business days, in line with compliance requirements.

If immediate danger or criminal activity is suspected, content may be removed sooner.

6. Counter-Notice Procedure (For Creators)

If you believe a DMCA notice or removal request was submitted in error, you may file a Counter-Notice.

Your Counter-Notice must include:

• Your name and contact information
• Identification of removed content
• A statement under penalty of perjury that the removal was incorrect
• Consent to legal jurisdiction if a dispute arises
• Your electronic signature

7. Complaints & Appeals

Complaints:

For all complaints, please contact us through info@footishfun.com. Complaints will be reviewed and resolved within five (5) business days. That resolution will then be communicated to the Complainant. Appeals or requests for any decision made should be presented, again, to info@footishfun.com.

Appeals:

If you have been depicted in any content and would like to appeal removal of such content, please notify us by email at info@footishfun.com. If there should be disagreement regarding an appeal, we will allow the disagreement to be resolved by a neutral party.

8. Repeat Infringers

Users who repeatedly violate:

• DMCA
• Copyright law
• Consent requirements
• Age verification rules
• Content standards

…will have their accounts permanently terminated.

We may also restrict their future ability to create a new account.
