FootishFun (“we”, “us”, “our”) respects the intellectual property rights of others and expects all users (“Sellers” and “Buyers”) to do the same.
This DMCA & Content Removal Policy outlines how copyright claims, content disputes, and removal requests are handled on our Platform. We comply with applicable UK, EU, US DMCA, and international copyright standards.
1. Copyright Ownership
All content uploaded by Sellers must be:
- Created by the Seller OR
- Content the Seller has full rights and ownership to upload, sell, or distribute
By uploading content, Sellers confirm they are the legal copyright owner or have explicit rights to use the material. Copyright infringement is strictly prohibited.
2. Zero-Tolerance Policy for Copyright Violations
We will remove or disable access to any content that:
- Infringes someone else’s copyright
- Is uploaded without permission
- Violates our Terms of Service or applicable law
Repeated violations may result in:
- Account suspension
- Permanent ban
- Forfeiture of earnings
- Reporting to legal authorities (if applicable)
3. How to Submit a DMCA Takedown Notice
If you believe your copyrighted material has been used on FootishFun without permission, you may request removal by submitting a formal DMCA Notice.

Your notice must include the following (as required by law):
- Your full name and contact information
- A description of the copyrighted work being infringed
- The exact URL(s) of the content in question
- Evidence that you own the content (e.g., original files, timestamps, screenshots)
- A statement confirming that you believe in good faith that the use is not authorised
- A statement confirming that the information in your notice is accurate
- A statement under penalty of perjury that you are the copyright owner or authorised to act for the owner
- A physical or electronic signature (typing your full name is acceptable)
Incomplete notices cannot be processed.
4. What Happens After You Submit a DMCA Notice
Once we receive a valid DMCA Notice:
- The content may be temporarily disabled or fully removed
- The Seller will be notified of the claim
- We will request evidence from the Seller if they dispute the claim
- We may freeze the Seller’s earnings from the disputed content
- We will evaluate all evidence provided
- A final decision will be made within 7–14 business days
If the claim is valid, the content will remain removed. If the claim is invalid or fraudulent, the content may be restored.
5. Counter-Notification Procedure
If a Seller believes the content was removed in error, they may submit a Counter-Notification.
A valid Counter-Notice must include:
- Seller’s full name and contact details
- Identification of the removed content
- A statement under penalty of perjury that the content was removed due to a mistake or misidentification
- Evidence supporting their ownership or license to use the content
- Consent to jurisdiction in their country AND willingness to comply with legal proceedings
- Their electronic or physical signature
Once a valid Counter-Notice is received:
- The original copyright claimant will be notified
- If the claimant does not initiate legal action within 10 business days, content may be restored
- If legal action is initiated, the content will remain offline until resolved by a court
6. Non-Copyright Content Removal Requests
Users may also request removal of content for reasons other than copyright infringement, including:
- Privacy concerns
- Personal safety issues
- Non-consensual imagery
- Mistaken uploads
- Violations of our Terms (e.g., prohibited content, underage implications)

7. Illegal or Underage Content
Any content suspected of involving minors or illegal acts will be:
- Immediately removed
- Reported to the appropriate authorities
- The user permanently banned
- All earnings forfeited
We comply fully with international child safety laws.
8. Repeat Infringer Policy
Users who repeatedly violate copyright or upload infringing content risk:
- Permanent account closure
- Forfeiture of unpaid earnings
- IP address bans
- Reporting to payment processors or authorities
9. Good Faith & Fraudulent Claims
We take DMCA notices seriously.
Filing false or fraudulent copyright claims may result in:
- Account suspension or ban
- Civil legal liability
- Criminal penalties (in some jurisdictions)
We reserve the right to ban anyone misusing the DMCA process.
10. Preservation of Evidence
During investigations, we may:
- Preserve content
- Capture screenshots
- Store logs and metadata
- Share evidence with legal authorities if required
We comply with all legal obligations to assist in investigations.
